SUMMARY

 

Under supervision of the VP/Chief Accounting Officer, leads the overall global tax function of the Corporation with a goal to optimize all taxes to which company and affiliated companies are subject, including federal, state/local, and international taxes. 

 

This role is also responsible for assurance that company public financial reporting responsibilities are completed accurately. As a key member of the finance team this role includes direct periodic tax consultation with, and an advisory capacity to, the company President and all Vice-Presidents. 

 

The function covers corporate U.S. and foreign tax planning, tax accounting, public partnership and tax compliance, related government tax examinations, and optimization is achieved through the development and implementation of effective tax strategies, efficient and effective tax reporting, management of the worldwide effective tax rate, and successful defense of tax audit challenges.  Tax responsibility covers reporting and/or approval of income taxes, public K-1s, franchise taxes, sales/use and VAT and GST taxes, property taxes, excise taxes, with an advisory capacity on payroll taxes, benefit issues, and other taxes. 

 

To achieve stated goals, direction and supervision of a qualified professional staff (CPA’ s, JD’ s, and other degreed personnel) is a basic requirement of the Tax Director.

 

ESSENTIAL DUTIES AND RESPONSIBILITIES

 
  1. Develop and implement tax efficient domestic and international structures, while achieving operational flexibility and administrative efficiency, to promote both cash tax savings and successful effective financial tax rate management.
  2. From a tax perspective, participate in acquisitions/divestitures and development of investment proposals, including development of related tax forecast models, in order to identify tax planning opportunities, recommend tax effective methods to optimize return on investment, and ultimately to add value to transactions through the tax function.
  3. Interface directly with federal, state/local, and international tax authorities, including coordination of tax examinations, identification of potential challenges to tax positions, negotiation of tax issues, filing of appeals, assistance to General Counsel in directing tax litigation, and assure that adequate support is prepared to successfully sustain the company’ s filing position.
  4. Direct the Tax Managers and staff in developing tax accounting public reporting duties to assure adequacy of ASC 740 book tax provisions and deferred income taxes, tax basis balance sheet, FIN48 tax reserves, and coordination with external tax consultants and audit firm to assure proper reporting.
  5. Monitor and anticipate changes in tax rules, regulations, and interpretation of these for all types of taxes, measurement of their impact, and ultimately recommendation to management of responsive action plans, followed by their successful implementation.
  6. Responsible for establishment, maintenance, and periodic review of the tax reporting system and key processes related to the tax function pursuant to Sarbanes-Oxley Sec. 404 so that such function adheres to 404 guidelines and so that material weaknesses to the tax function in all published financial statements are avoided.
  7. Oversee Tax Managers and staff in preparation and filing of federal, international, partnership filings including master limited partnership, state/local income and franchise returns, property, sales/use tax returns, and VAT or GST returns (when not assigned to a business unit).  Provide direction to tax department personnel in consulting with external advisors in these areas.
  8. Lead the tax department in identifying and implementing best practices

Belong to professional tax associations which promote competence and professionalism among its members through the providing of educational tax programs, publication of professional materials, timely information on emerging tax trends and challenges, and an overall format that lends itself to the formation of professional associations— all of which will benefit the Tax Director and, by extension, Westlake itself.

QUALIFICATIONS

EDUCATION and/or EXPERIENCE 

 
  1. CPA Required or JD Preferred; Public Accounting experience highly desirable.
  2. Bachelor’ s degree in Accounting from a 4 year college or university.
  3. Minimum 10 years work experience including experience with accounting for income taxes (ASC 740). Proven experience as head of corporate tax dept. or comparable company or direction of equivalent major tax functions.

 

PHYSICAL DEMANDS

 

While performing the duties of this job, the employee is frequently required to sit; stand; walk; use hands to touch, handle, or feel; reach with hands and arms; and talk or hear.  The employee is occasionally required to stoop, kneel, or crouch.  The employee must regularly lift and/or move up to 10 pounds, frequently lift and/or move up to 25 pounds, and occasionally lift and/or move up to 50 pounds.  Specific vision abilities required by this job include close vision, distance vision, color vision, peripheral vision, depth perception, and ability to adjust focus.

 

WORK ENVIRONMENT

 

The noise level in the work environment is usually moderate as normally based in an office.  Some of the work may be required in the operating units which can require usage of required PPE including safety glasses, hearing protection, etc.  May also result in exposure to outside elements and may require usage of stairs and elevators.  Travel up to 10% including air travel or auto travel.
